Attorney General William Barr told Congress on Tuesday that he doesn’t believe police departments are systemically racist, pushing back against Democrats’ overarching justification for implementing sweeping police reforms after high-profile, police-involved deaths of Black Americans.
His comments came during a House Judiciary Committee hearing where Rep. Sheila Jackson Lee, D-Texas, pressed Barr on the administration’s efforts to counter systemic racism. “I don’t agree there’s systemic racism in the police department, generally, in this country,” Barr said.
In his opening statement, Barr said it was “understandable” that African Americans harbored distrust towards the police, and acknowledged perceptions of bias during police encounters.
“At the same time, I think it would be an oversimplification to treat the problem as rooted in some deep-seated racism generally infecting our police departments,” he added.
“It seems far more likely that the problem stems from a complex mix of factors, which can be addressed with focused attention over time. We in law enforcement must be conscious of the concerns and ensure that we do not have two different systems of justice.”
Barr’s comments came as House Democrats passed policing reform legislation that has been painted as a way to address systemic racism. The Justice in Policing Act of 2020 includes coooperation from Barr’s department, including in the creation of a task force overseeing law enforcement in the U.S.
After the bill’s passage, Congressional Black Caucus Chair Karen Bass said: “For far too long, Black Americans have endured systemic racism and discrimination—especially from police. Congress may have written this bill, but the people own it.”
As proof of sytemic racism, Jackson Lee pointed to Minneapolis, where George Floyd died in May while in police custody. “While Black people make up 19 percent of the Minneapolis population and 9 percent of its police, they were on the receiving end of 58 percent of the city’s police use of force incidents,” she said, apparently referring to a New York Times analysis of city data.
“In addition, we’ve seen that Black men are twice as likely to be stopped and searched; Hispanic drivers, 65 percent receive a ticket; and Native Americans in Arizona three times more likely to be searched when they are stopped,” she continued.
Jackson Lee added that she needed Barr to recognize systemic racism and that unless he did, the U.S. wouldn’t be able to realize the civil rights vision advanced by recently-deceased Rep. John Lewis, D-Ga.
Conservatives have generally pushed back on the term, arguing that law enforcement statistics indicate racism isn’t systemic.
Data compiled by The Washington Post reveals that Black people, who make up 13 percent of the U.S. population, accounted for 25 percent of those shot and killed by police since 2015; White people, accounting for 60 percent of the population, accounted for 45 percent of those killed by police officers.
Heather Mac Donald, a scholar at the right-leaning Manhattan Institute, has pushed back on the idea of systemic racism. In a Wall Street Journal op-ed from June, she wrote: “A solid body of evidence finds no structural bias in the criminal-justice system with regard to arrests, prosecution or sentencing. Crime and suspect behavior, not race, determine most police actions.”
She cited an August 2019 study from the Proceedings of the National Academy of Sciences. “We find no evidence of anti-Black or anti-Hispanic disparities across shootings,” the authors concluded, “and White officers are not more likely to shoot minority civilians than non-White officers. Instead, race-specific crime strongly predicts civilian race. This suggests that increasing diversity among officers by itself is unlikely to reduce racial disparity in police shootings.”
As Jackson Lee noted, a spate of high-profile Black deaths have captured media attention and fueled claims that the U.S. policing systematically targets Black individuals. She specifically accused Barr of ignoring racial injustice because the DOJ, under President Trump, had only pursued one “pattern or practice” investigation, which she said targets racism at an institutional level.
Jackson Lee also pointed to the number of cases brought under Section 242, which prohibits law enforcement from depriving Americans of their Constitutional rights and privileges. “And are you aware of how many cases we’ve had — 184,275, which means that in FY2019, only about 27 out of every 100,000 prosecutions was related to Section 242 charges?” she asked.
Barr attempted to respond by claiming that his criminal prosecutions under Section 242 were “extremely strong.” He added that at the beginning of 2020, “very few jurisdictions had grand juries that we’re open.”
Jackson Lee responded: “I think the reason is … your focus was more to let out friends like [former Trump campaign advisers] Roger Stone and Paul Manafort, while Tamir Rice, whose case has not been taken up, was playing with a toy gun, was killed by police at the age of 12, Breonna Taylor was sleeping in her apartment when she was killed by police at age 26, and of Rayshard Brooks, 27, was killed just for sleeping in his car in a Wendy’s parking lot,” she said, before mentioning Floyd’s death.
Brooks was killed after an exchange in which he stole an Atlanta police officer’s taser. Although the initial encounter began with him sleeping in his car, it also included a sobriety test and being questioned by the officers. A struggle ensued when the officers tried to arrest Brooks. As he was was running away from the officers while holding the officer’s taser, he was shot in the back by Garrett Rolfe, who was later fired from the Atlanta Police Department and now faces 11 charges, including felony murder, related to the incident.

When you see the violence, looting and murder in Kenosha and in Portland, it is a miracle that more terrorists are not shot by the police.
The majority of police shootings I have seen or read about involved suspects resisting arrest.
I think that a starting point for discussion would be to create respect for police in the Black communities. When they go into a neighborhood and are greeted with lound anti police rap music and hostile behaviour its hard not to be concerned for your life and quick to respond.
I think police are afraid of blacks and blacks are afraid of police that is a formula for disaster.
If both groups did not have to go into an encounter with fear of being harmed that would go a long way in reducing the chance of a violent exchange.
I agree with A.G. Barr regarding it being fake news. However, Obama did his dead level best to resurrect systemic racism during every one of his eight years in office. After 50 years of progress since the Civil Rights movement, Obama and his operatives did all they could to promote racism across this country.
In order for their to be systemic racism,an entire race of people have to dislike another,or in the case of the police,all of them would have to dislike an entire race of people.This cannot be true especially for the police because there are all races of people in the police department.

As a retired LEO and Supervisor, I had ‘The Training’ that the Left is talking about. We officers were trained in the academy to base our contacts and stops on probable cause, actions and behavior. At no time is race, creed, nationality or skin color ever to be considered or used. Demographics (composition) of communities makes for the statistics Rep. Lee (D) Texas is so adamant to push into the light. As officers, we don’t get a whole lot of choice on what we do. We go where we are needed, no matter the neighborhood, damn the demographics. We serve the entire community. Remember that. In closing, you have to give respect in order to get respect. If an officer addresses you as ‘Sir’ is it not appropriate for you to do the same? Or, do you lay into the officer with profane verbiage and racially charged epithets? We officers were also taught to let the contact subject (Suspect) determine the outcome. There is a lot a citizen can do to make a ‘Police Encounter’ positive. A little bit of common courtesy goes a long way. It may not keep you from getting a ticket, but it will keep you in better regards with law enforcement.

Perhaps if “they” didn’t commit a disproportionate amount of the city’s crime and didn’t resist arrest, they wouldn’t be arrested with force disproportionately.
